The Individual Voluntary Arrangement is a legally binding agreement between an individual and their creditors, providing a structured repayment plan to clear debts over a specified period, in this instance he had an agreement to pay back over £6,000 over 6 years with his creditors agreeing to write off over £25,000 of his debt.
By 2022, after paying into his IVA for 3 years and with his circumstances changing, our client responded to a referral to a solicitor’s practice claiming financial mis-selling and enticing people to pursue a mis-sold IVA claim. With the advert resonating with him, he was convinced to terminate his IVA prematurely and use his disposable income to buy a report into his situation.
Having lost 3 years of IVA fees due to the termination, with no protection from his creditors, the solicitors practice withdrew from the claim after charging him £550 for the report.
He was left high and dry with his creditors circling.
